Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Concore Cabinetry regarding the use of our website and services. This agreement supersedes any prior agreements, understandings, or communications between you and Concore Cabinetry, whether written or oral. By accessing and using our website, you agree to be bound by these terms.
Cancellation
Orders placed with Concore Cabinetry can be canceled within 24 hours of the order placement without any penalty. To cancel an order, you must contact our customer service team . After 24 hours, cancellations may not be accepted or may incur a restocking fee. Custom orders cannot be canceled once production has begun.
Delivery
Concore Cabinetry aims to deliver your products within the estimated delivery time provided at the time of purchase. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by factors beyond our control. All deliveries will be made to the address specified during the order process. Any changes to the delivery address must be communicated to us promptly.
Inspection and Acceptance
Upon receiving your order, you are responsible for inspecting the products for any damages or discrepancies. Any issues must be reported to Concore Cabinetry within 48 hours of delivery. Failure to inspect and report within this time frame will be considered acceptance of the products as delivered. If any defects are found, please contact our customer service immediately to resolve the issue.
Warranties
Concore Cabinetry provides a limited warranty on all of our products. This warranty covers defects in materials and workmanship under normal use for a period specified at the time of purchase. During the warranty period, Concore Cabinetry will repair or replace, at no charge, products or parts of a product that proves defective because of improper material or workmanship, under normal use and maintenance.
Exclusions:
This limited warranty does not cover any problem that is caused by conditions, malfunctions, or damage not resulting from defects in material or workmanship. This includes, but is not limited to:
- Damage caused by improper installation or maintenance
- Normal wear and tear
- Damage due to environmental factors such as humidity or temperature fluctuations
- Products altered or repaired by unauthorized persons
- For warranty service, please contact our customer service team with proof of purchase and details of the defect.
Our team will guide you through the warranty process and assist in resolving the issue.
Indemnification
You agree to indemnify, defend, and hold harmless Concore Cabinetry, its officers, directors, employees, agents, and affiliates, from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to your use or misuse of our website, violation of these Terms and Conditions, or infringement of any intellectual property or other rights of Concore Cabinetry or any third party.
This clause ensures that you, as the user, will cover any losses or damages Concore Cabinetry incurs due to your actions.
Termination
Concore Cabinetry reserves the right to terminate or suspend your access to the website and its services, without prior notice or liability, for any reason, including but not limited to a breach of these Terms and Conditions. Upon termination, your right to use the website will immediately cease. All provisions of these Terms and Conditions which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent necessary. The remaining provisions of these Terms and Conditions will continue to be in full force and effect.
This clause ensures that if any part of the agreement is deemed invalid or unenforceable, the rest of the terms will remain valid and enforceable.
Limitations of Liability
To the fullest extent permitted by applicable law, Concore Cabinetry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the website; (ii) any conduct or content of any third party on the website; (iii) any content obtained from the website; and (iv) unauthorized access, use, or alteration of your transmissions or content.
This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not Concore Cabinetry has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Non-Waiver
The failure of Concore Cabinetry to enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by an authorized representative of Concore Cabinetry.
This clause ensures that if Concore Cabinetry does not enforce a part of the agreement at any time, it does not mean that they waive their right to enforce it in the future.
Dispute Resolution
Any disputes arising out of or related to these Terms and Conditions or the use of Concore Cabinetry’s website shall be resolved through negotiation between the parties. If such efforts prove unsuccessful, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association, or a similar body.
The arbitration will take place in the jurisdiction specified below. The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
